The current website is an online offer of the Theaterservice GmbH. An extensive range of information and online services concerning the productions and performances of our company are on display under this website address and all relevant sub domains.

1. Terms and Conditions

The general terms and conditions apply to the completion of rental contracts via the Theaterservice GmbH.  Deviations from the conditions are only valid if they are agreed to in writing by the Theaterservice GmbH. With the payment of the rent the tenant declares his/herself to be understanding of the general terms and conditions and to be bound to them.

2. No application of the law of tenancy

The rental contract is not subject to the Austrian law of tenancy.

3.  Non-binding enquiries

Enquiries regarding the availability of apartments are non-binding on both sides.

4. Lease and realisation of a contract

The Theaterservice GmbH creates a binding offer on request with regards to the available tenancy period and rental fee. All terms of the rental contract are already included within the offer.

Within three days of releasing the offer, Theaterservice GmbH is required to ensure the availability of the apartment according to the provided terms. Within these 3 days the interested party must transfer the agreed rental fee along with the deposit of 200 EUR to the following account:

Proof of payment should also be forwarded to Theaterservice GmbH within these 3 days; otherwise the obligation of the Theaterservice GmbH expires.

A binding contract comes into being with the transferral of the rental fee and the deposit from the interested party.

5. Moving in

The apartment can be taken over from 15:00 on the day of arrival and must be vacated by 12:00 on the day of departure.

6. Rights and obligations

Animals are not permitted within the apartments.  The tenant must adhere to the applicable house rules.

With prior notice a Theaterservice GmbH representative has authorisation to enter the apartment during the duration of the current rental contract.

No responsibility is taken for any valuables which are lost or stolen within the apartment.

No services such as cleaning, laundry, waste disposal etc. are offered to the tenant by the Theaterservice GmbH during the tenancy period. The tenant his/herself is responsible for the upkeep of the apartment during his/her stay.

7. Cancellation

In the event of cancellation of the contract by the tenant, the full rent sum as outlined in Article 4 will be forfeited as a cancellation fee if the cancallation is made less than a month before the beginning of the tenancy period.

8. Right of Termination

The Theaterservice GmbH retains the right to dissolve a contract with immediate effect - irrespective of the agreed length of the tenancy period - particularly when the tenant abuses the agreements outlined within the contract and damage to the apartment is consequently feared.

9. Price Quotation

Complete price quotations are understood to be the gross price, incl. VAT (unless any other indications are given).

Price quotations given to a client in response to an enquiry retain their validity for up to 3 days. After the lapse of this deadline the Theaterservice GmbH is no longer required to draw up a contract with the stated price quotation.

10. Data Protection Act Guideline

The tenant accepts that their personal details will be ascertained, stored and processed via EDP-supported means for the Bundestheater. The details will be used in electronic and written form in order to send post to the tenant for advertising and promotional purposes; the tenant can withdraw their consent at any time.

11. Place of delivery, Choice of law and jurisdiction

Place of delivery is Vienna.  Austrian law is applied to contracts concerning the Theaterservice GmbH.
